Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the Clarion app ("the App") or visiting clarionapps.com ("the Website"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the App or Website. These Terms constitute a legal agreement between you and Clarion Apps ("we," "us," or "our").

2. Description of Service

Clarion provides access to publicly available police, fire, and EMS radio scanner audio streams, along with AI-powered transcription, incident mapping, historical data, statistics, and community-sourced incident reports. The App also displays publicly available sex offender registry data from the NSOPW database.

3. Eligibility

You must be at least 17 years old to use Clarion. The App is rated 17+ due to the nature of emergency scanner content, which may include descriptions of violence, criminal activity, medical emergencies, and other sensitive topics.

4. Acceptable Use

You agree NOT to:

  • Use information from Clarion to interfere with emergency operations, law enforcement activities, or first responder work
  • Travel to active crime scenes, emergencies, or incidents based on information from the App
  • Use the App to stalk, harass, or locate specific individuals
  • Redistribute, re-broadcast, or commercially exploit scanner audio or transcriptions without authorization
  • Submit false, misleading, or intentionally harmful community reports
  • Attempt to reverse-engineer, decompile, or extract source code from the App
  • Use the App in any way that violates applicable local, state, or federal laws
  • Use sex offender registry data to harass, threaten, or intimidate any individual

5. Scanner Content and Accuracy

Scanner feeds are sourced from publicly available radio communications. You acknowledge that:

  • Content may be inaccurate. Radio communications reflect real-time, unverified reports. Initial dispatch information is frequently incomplete or incorrect.
  • AI transcriptions are approximate. Automated transcription of radio traffic involves inherent errors due to signal quality, jargon, codes, overlapping transmissions, and accents. Transcriptions should not be treated as verbatim records.
  • Incident data is not official. Incident locations, categories, and details are algorithmically derived and may be incorrect. Clarion is not affiliated with any law enforcement or emergency services agency.
  • Feed availability varies. Scanner feeds may go offline, change frequencies, or become unavailable at any time without notice.

6. Sex Offender Registry Data

Sex offender registry information displayed in the App is sourced from publicly available databases maintained by government agencies. This data is provided for informational purposes only. We do not independently verify this data. Misuse of sex offender registry information, including using it to harass or threaten individuals, is prohibited by federal and state law.

7. Community Content

Users may submit incident reports, photos, videos, and comments ("Community Content"). By submitting Community Content, you:

  • Grant us a non-exclusive, royalty-free, worldwide license to display, distribute, and moderate your content within the App
  • Represent that you have the right to share the content and that it does not violate any third party's rights
  • Acknowledge that we may remove any content at our sole discretion without notice
  • Accept that Community Content is user-generated and we are not responsible for its accuracy or legality

8. No Emergency Service

Clarion is NOT an emergency service. Do not rely on the App for emergency information. Always call 911 or your local emergency number in an emergency. The App may have delays, inaccuracies, or outages that make it unsuitable for emergency use.

9. Intellectual Property

The App, Website, and all associated branding, design, code, and non-user-generated content are owned by Clarion Apps and protected by intellectual property laws. You may not copy, modify, or distribute any part of the App or Website without our written permission.

10. Disclaimer of Warranties

THE APP AND WEBSITE ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLARION APPS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP OR WEBSITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM, OR $50, WHICHEVER IS GREATER.

12. Indemnification

You agree to indemnify and hold harmless Clarion Apps and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the App, violation of these Terms, or infringement of any third party's rights.

13. Termination

We may suspend or terminate your access to the App at any time, without notice, for any reason, including violation of these Terms. Upon termination, all licenses granted to you under these Terms cease immediately.

14. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law provisions. Any disputes shall be resolved in the courts of Los Angeles County, California.

15. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated date. Your continued use of the App after changes constitutes acceptance of the revised Terms.
